Poland’s New Act on Restructuring Law: Long Awaited and Much Anticipated. What is its significance for debtors, creditors and advisors in the business community?

We would like to invite you to the next breakfast meeting, which refer to the Restructuring Law. The meeting is organised in co-operation with the Commercial Section of the Austrian Embassy and will take place on 23th September. Content partner of the meeting is Wolf Theiss.


On 1 January 2016 the new Act on Restructuring Law will enter into force. This law implements a significant reform of Polish insolvency law with a focus on restructuring and avoiding liquidation. 


During the seminar the most essential changes implemented by the new provisions will be discussed, including:
• introduction of new restructuring proceedings,
• new definition of insolvency,
• procedures impacting the influence of creditors on the course of the restructuring and bankruptcy proceedings,
• concluding restructuring arrangements with the largest creditors without the necessity to engage the remaining creditors,
• pre-pack sales of bankrupt enterprises,
• limitations of the priority of public claims in bankruptcy proceedings,
• creation of a new electronic platform, Central Restructuring and Insolvency Register,
• simplified filing claims, e.g. in electronic form.
