Pietkiewicz joins from CMS Cameron McKenna, where he headed its Poland dispute resolution practice. He advises on a wide range of matters and has broad experience in the demanding sectors. Pietkiewicz joins the Warsaw Dispute Resolution Practice team with 19 other lawyers, including five new local partners: Łukasz Hejmej, Tomasz Manicki, Sebastian Pabian, Paweł Samborski and Michał Subocz, all from CMS Cameron McKenna. Hejmej specializes in insurance and corporate disputes and arbitration proceedings. Manicki is experienced in proceedings regarding criminal commercial and fiscal law, as well as compliance procedures. Pabian specializes in insurance and regulatory disputes. Samborski and Subocz are experienced in advising on construction disputes and arbitration proceedings.

The appointment of Pietkiewicz and his 19-member-strong team follow the announcement of the arrival of a number of new partners in White & Case’s CEE Dispute Resolution Practice.

In January, Paraschiva (Peggy) Şuică-Neagu joined the Firm as a partner and head of its Bucharest Dispute Resolution Practice. In mid-2010, the Firm announced the arrival of partner David Goldberg, a leading Russian-speaking international arbitration lawyer, who is based in Moscow and London. Earlier in 2010, Milan Kohlrusz joined White & Case as a partner and head of its Dispute Resolution Practice in Budapest, adding significant experience in administrative, commercial and civil litigation and in the resolution of sensitive conflicts with various governmental bodies in the Hungarian courts, as well as the European Court of Justice.

Pietkiewicz and his team’s arrival continues the build-out of White & Case’s CEE Dispute Resolution Practice as part of the Firm’s broader strategy of expanding its global disputes team, which currently numbers more than 700 lawyers.

VAT

Several amendments to the VAT Act entered into force on 1 January 2011, thus jointly constituting the greatest change of the said tax since 2004.

From 1 January 2011 the basic tax rate amounts to 23% and the reduced rates amount to 8% and 5%, respectively. The long-term plan provides for further increases in the VAT rates, if the level of public debt of Poland exceeds the so-called prudential threshold of 55%. Due to the change of the VAT rates, several interim provisions have been introduced that regulate the rules of transition to the new rates and the ultimate return to the VAT rates applicable at the end of 2010.

Pursuant to the adopted amendment, the Polish Classification of Products andServices (Polska Klasyfikacja Wyrobów i Usług -PKWiU) of 1997 will nolonger be used for VAT purposes, being replaced with the PKWiU of 2008.Due to the significant differences between the two classifications, in order todetermine the correct VAT rate for a given product or service, it is necessaryto verify the practices applied so far.

The appendix number 4 to the Act -including the list of exemptions -has been deleted and the said list has been deleted and the said list has been included directly in Article 43 of the VAT Act. It should be pointed out that the scope of many exemptions has been modified, thus it is necessary to verify the practices applied so far.

New rules have been introduced with regard to the settlement of gratuitous delivery of goods and gratuitous provision of services.

The changes in the VAT Act have introduced new regulations with respect to the manner of specification of the right to deduct VAT charges in relation to the purchase of a real property used within the scope of the conducted business activity and for private purposes.

The changes in the regulations provide that from 1 January 2011 until the end of 2012 purchasers and lessees of passenger cars equipped with a cargo partition, who until the end of 2010 had the right to a full deduction of tax, will be permitted to deduct only 60% of the VAT amount, and not more than 6,000 zlotys. Moreover, deduction of tax on purchased fuel for such cars will no longer be possible. This applies also to vehicles purchased on the previous, favourable terms.

“This is a milestone deal that opens up the path for subsequent hryvnia bond issues on the international markets,” commented White & Case partner Stuart Matty. “Borrowers are looking for protection from currency fluctuation and investors are attracted by the potential benefit from currency appreciation. Buyers who are keen on Ukrainian currency exposure but want settlements via the international clearing systems now have that option open to them.”

White & Case also advised Citigroup and Credit Suisse on Ukreximbank’s offering of U.S.$500,000,000 8.375 per cent Loan Participation Notes due 2015 issued by Biz Finance plc in April 2010.

Die Projektarbeiten wurden mit einer Analyse von Geschäftsvorgängen und mit der Entwicklung eines Implementierungskonzepts begonnen. Der Produktionsstart des Systems ist für den 1. Oktober 2011 geplant. Das Ziel der Implementierung des Systems SAP ERP ist volle Verkaufsautomatisierung, Optimierung der Geschäftsbereiche des Unternehmens, sowie die Einführung von Managementstandards, die in westlichen Unternehmen auftreten.

Jessup is the world’s largest moot court competition. More than 2,000 law students participate each year, representing over 550 law schools from 80 countries. Students are required to present oral and written arguments on a hypothetical international law case to a simulated International Court of Justice. Most teams will compete first in the national and regional competitions to earn the right to advance to the 2011 White & Case International Rounds, which will be held 20-26 March in Washington, DC. The winning team will take home the White & Case Jessup Cup.
The 2011 Jessup Problem addresses several issues between two fictional countries, including the legality of military air strikes using unmanned drones, a ban on women’s clothing that has religious significance and bribery and corruption.
